The Cameron Parish Police Jury met in regular session on Tuesday, March 10, 2020, in the Cameron Parish West Annex Board Room in the Village of Cameron, Louisiana at 2:00 o’clock p.m. The following members were present: Mr. Magnus McGee, Mr. Scott Trahan, Mr. Kirk Quinn, Mr. McKinley Guidry, Mr. Thomas McDaniel, Mr. Curtis Fountain and Mr. Lawrence Faulk. The following member was absent: Mr. Joe Dupont.
There was no Public Comment on the agenda items.
It was moved by Mr. Fountain, seconded by Mr. Quinn and carried, that the reading of the minutes shall be dispensed with and approved.
It was moved by Quinn, seconded by Mr. Fountain and carried, that the board hereby approves to add the following item to the agenda: (Item 21) President Authority to sign Resolution of Support for the Rail Feasibility Study (Item 22) Authority to Advertise to Amend Parish Ordinance Chapter 12 Library Section 3(a) to correspond with the Louisiana Revised Statute

Sabine Pass LNG, L.P. – 9243 Gulf Beach Highway, Johnson Bayou, Section 19, 20, T15S, R15W (proposed SPLNG Dredge Maintenance Project; project includes to maintenance dredge an existing marine berth, and existing construction dock, and a proposed new marine berth along the Sabine River channel in Cameron Parish. Activities include dredging annually from these areas and placing the material into Louisiana Point Beneficial Use Area (BUA) for shoreline protection, creation of a wetlands and wildlife habitat), Cameron Parish, LA. It was moved by Mr. Trahan, seconded by Mr. Quinn and carried the board does hereby appoint Wendy Harrington to the Lower Cameron Hospital District No. Two Board.
It was moved by Mr. Guidry, seconded by Mr. Quinn and carried the board does hereby appoint Marsha Delaney to the Gravity Drainage District No. Eight Board for the expired term of Ted Joanen and directs the Secretary to send a letter of appreciation to Mr. Joanen for his service to the board.
It was moved by Mr. Trahan, seconded by Mr. McDaniel and carried the board does hereby reappoint DeDe Sanders to the Fire Protection District No. One Board.
It was moved by Mr. Trahan, seconded by Mr. Fountain and carried the board does hereby reappoint Jude Primeaux to the Fire Protection District No. Seven Board.
It was moved by Mr. Trahan, seconded by Mr. Faulk and carried the board does hereby reappoint Neal Conner to the Fire Protection District No. Seven Board.

It was moved by Mr. Quinn, seconded by Mr. Fountain and carried, the board does hereby reappoint Ron Johnson to the Fire Protection District No. Fourteen Board.
It was moved by Mr. Faulk, seconded by Mr. Quinn and carried, the board does hereby reappoint C.S. Darrbonne to the Fire Protection District No. Fourteen Board.
It was moved by Mr. Quinn, seconded by Mr. Faulk and carried, the board does hereby reappoint Greg Manuel to the Fire Protection District No. Fourteen Board.
It was moved by Mr. McDaniel, seconded by Mr. Quinn and carried, the board does hereby reappoint Tommy Arceneaux to the Gravity Drainage District No. Eight Board.
It was moved by Mr. Quinn, seconded by Mr. Faulk and carried, the board does hereby reappoint Wayne Hebert to the Waterworks District No. Eleven Board.
It was moved by Mr. Trahan, seconded by Mr. Faulk and carried, the board does hereby accept the resignation of Oren DeBarge from the Gravity Drainage District No. Three Board, directs the secretary to send a letter of appreciation to Mr. DeBarge for his service to the board and appoints Shirley Grey for the remainder of term.
It was moved by Mr. McDaniel, seconded by Mr. Fountain and carried, the board does hereby accept the resignation of Bryan Granger from the Waterworks District No. Eleven Board, directs the secretary to send a letter of appreciation to Mr. Granger for his service to the board and tables the appointment for 60 days due to Mr. Granger’s term expiring 5/5/2020.
The President Magnus McGee, opened a public hearing to hear and consider comments on proposed amendment to Chapter 10, Article VII – Temporary Food Service – Festivals and Fairs for Temporary food service vendors to sell food or drink in a temporary location on Holly Beach. There was one written letter of support submitted by Bobby Miller. Juror Lee Faulk commented that some of his constituents had expressed concerns about the ordinance eventually including the entire Parish and stated they did not want food trucks in parts of the Parish and also encouraged him to vote against the ordinance. After all comments were addressed it was move by Mr. Trahan, seconded by Mr. Fountain and carried, the public hearing was declared closed.
The following amendment to Chapter 10, Article VII – Temporary Food Service – Festivals and Fairs was offered by Mr. Fountain, seconded by Mr. Trahan and declared adopted. The vote was recorded as follows:
FOR: Scott Trahan, McKinley Guidry, Thomas McDaniel, Curtis Fountain, Lawrence Faulk, Magnus Mcgee.
AGAINST: Kirk Quinn
ABSENT: Joe Dupont
AMENDMENTS TO CHAPTER 10 ARTICLE VII. TEMPORARY FOOD SERVICE – FESTIVALS AND FAIRS
Sec. 10-68. Recognized Festivals and Fairs
For purposes of the Louisiana Sanitary Code, the following festivals and fairs are hereby officially acknowledged by the police jury as recognized festivals and fairs within the Parish of Cameron:
(1) Louisiana Fur and Wildlife Festival
(2) St. Mary of the Lake Fall Food Festival
(3) Grand Chenier Alligator Festival
(4) Summer Bayou Bash Festival
(5) Hackberry Duck-Off
(6) Cameron Saltwater Fishing Festival
Temporary food service vendors may sell food and/or drink in a temporary location at the above listed fairs and festivals, provided such vendor is in compliance with all applicable provisions of the Louisiana Sanitary Code. Neither a Temporary Food Service Permit, nor an Occupational License are required for temporary food vendors selling at a recognized festival or fair listed above.
Sec 10-69. Temporary Food Vendors: Holly Beach
Temporary food service vendors can sell food or drink in a temporary location on Holly Beach provided:
(1) Such vendors must be compliance with all provisions of the Louisiana Sanitary Code; and
(2) A Temporary Food Service Permit must be obtained from the Cameron Parish Police Jury before an occupational license can be purchased.
(3) The Temporary Food Service Permit may be purchased from the Cameron Parish Police Jury at a cost of $100.
(4) The Temporary Food Service Permit is valid from the date of issuance until December 31 of the year of issuance.
(5) The Temporary Food Service must be located in a site which is both reasonably safe and convenient for the public and must be approved by the Cameron Parish Police Jury Permitting Office.
(6) A limit of no more than 4 temporary food service permits issued within one-year, excluding vendors selling food products such as ice cream, frozen novelties, snow cones, etc.
Sec. 10-70. Non-Profit Temporary Food Service Vendors
In areas of the parish not covered by Sec. 10-69, a Temporary Food Service vendor can sell food or drink in a temporary location only if:
(1) The Temporary Food Service Vendor is a non-profit organization or is operating on behalf of or for the benefit of a non-profit organization.
(2) Such vendor is in compliance with all applicable provisions of the Louisiana Sanitary Code; and
(3) A Temporary Food Service Permit must be obtained from the Cameron Parish Police Jury before an occupational license can be purchased.
(4) The Temporary Food Service Permit may be purchased from the Cameron Parish Police Jury at a cost of $100.
(5) The Temporary Food Service Permit is valid from the date of issuance until December 31 of the year of issuance.
(6) The Temporary Food Service must be located in a site which is both reasonably safe and convenient for the public and must be approved by the Cameron Parish Police Jury Permitting Office.
Sec. 10-72. Permits
A valid permit shall be posted in every mobile food service facility, where visible. Permits are not transferable. Permit fees will not be pro-rated based on the date of issuance. The Temporary Food Service Permit referenced above can be waived or reduced for non-profit organizations, in the discretion of the Cameron Parish Police Jury Permitting Office.
In response to an advertisement for the acceptance of bids for the CDBG-DR Rockefeller Shoreline Protection ME37 12PARA3301 Project, the following bids were received:

Fenstemaker and Associates, LLC, it was moved by Mr. Fountain, seconded by Mr. Faulk and carried, the board hereby accepts the bid of Rigid Constructors, LLC with the base bid of six million seven hundred forty-four thousand three hundred dollars and 00/100 cents for the CDBG-DR Rockefeller Shoreline Protection ME37 12PARA3301 Project, and hereby authorizes, empowers and directs the President to sign all contracts pertaining to said bid. Considering the bid of Rigid Constructors, LLC as the lowest responsible bid and on a recommendation of C.H. Fenstemaker and Associates, LLC, it was moved by Mr. Quinn, seconded by Mr. McDaniel and carried, the board hereby accepts the bid of Rigid Constructors, LLC with the base bid of two million nine hundred eighty seven thousand seven hundred fifty dollars and 00/100 cents for the GOMESA Project – Phase 2 Long Beach Project No. 2189153, and hereby authorizes, empowers and directs the President to sign all contracts pertaining to said bid.

RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH THE LOUISIANA DEPARTMENT OF TRANSPORTATION AND DEVELOPMENT FOR A GRANT UNDER ANY OF THE FOLLOWING FTA PROGRAMS MANAGED THROUGH LOUISIANA DEPARTMENT OF TRANSPORTATION AND DEVELOPMENT.
• 49 CFR 5311, FORMULA GRANT FOR RURAL AREAS
• 49 CFR 5310, FORMULA GRANTS FOR THE ENHANCED MOBILITY OF SENIORS AND INDIVIDUALS WITH DISABILITIES
WHEREAS, the Secretary of Transportation and Development is authorized to make grants for mass transportation projects;
WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provisions by it of the local share of project costs;
WHEREAS, it is required by the Louisiana Department of Transportation and Development in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and
WHEREAS, it is the goal of the Applicant that minority business enterprise be utilized to the fullest extent possible in connection with this project, and that definitive procedures shall be established and administered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment, or consultant and other services:
NOW, THEREFORE, BE IT RESOLVED by the Cameron Parish Police Jury;
1. That the Parish Administrator is authorized to execute and file an application on behalf of the Cameron Parish Police Jury with the Louisiana Department of Transportation and Development, to aid in the financing of operating and/or capital assistance projects pursuant to FTA transit programs.
2. That the Parish Administrator is authorized to execute and file with such applications an assurance or any other document required by the Louisiana Department of Transportation and Development effectuating the purposes of Title VI of the Civil Rights Act of 1964, as amended.
3. That the Parish Administrator is authorized to furnish such additional information as the Louisiana Department of Transportation and Development may require in connection with the application or the project.
4. That the Parish Administrator is authorized to set and execute affirmative minority business policies in connection with the project’s procurement needs.
5. That the Parish Administrator is authorized to execute grant contract agreements on behalf of the Cameron Parish Police Jury with the Louisiana Department of Transportation and Development for aid in the financing of the operating or capital assistance projects.
6. This resolution is applicable for a period of one year unless revoked by the governing body and copy of such revocation shall be furnished to the DOTD.

STATE OF LOUISIANA
WHEREAS, Cameron Parish was created by Act No. 102 of 1870 of the state of Louisiana in General Assembly and was approved on Tuesday, March 15, 1870. On Wednesday, March 16, 1870 in accordance with Act 102 of that year, Cameron Parish was established from the southern part of Calcasieu Parish and from the Southwestern corner of Vermilion Parish.
WHEREAS, Cameron Parish and its residents have shown great resilience, strength and stabilization for the past 150 years recovering from three major named storms, Hurricanes Audrey, Rita and Ike.
WHEREAS, Cameron Parish is now and has been for the past 150 years rich and abundant in natural resources such as oil, gas, wild game, fish, fur-bearing animals and cattle.
NOW THEREFORE, BE IT RESOLVED, by the Police Jury of the Parish of Cameron, Louisiana, in regular session convened on this 10th day of March 2020, would like to Salute Cameron Parish’s Sesquicentennial Anniversary.

STATE OF LOUISIANA
WHEREAS, from the early beginnings, the Blinded Veterans Association members demonstrated to all veterans with visual impairments how to take their rightful place in the community creating a world built upon equality, and
WHEREAS, BVA, aster 75 years still continues to advocate the veterans with combat related, accidental or age-related vision impairments to regain independence, confidence and self-esteem through rehabilitation, training and assisting their fellow veterans with visual impairments, and
WHEREAS, we recognize that the goals and ideals of BVA should be supported by citizens everywhere, and
WHEREAS, The Louisiana/Mississippi affiliate of the Blinded Veterans Association is dedicated to improving blind rehabilitation services, education and benefits for blinded veterans throughout the United States, and
WHEREAS, many Americans recognize March 28th of each year as Blinded Veterans Day.

WHEREAS, Cameron Parish has experienced rapid growth in recent years; and
WHEREAS, the lack of rail accessibility has restricted the potential of the Parish from advancing to the next level; and
WHEREAS, the Cameron Parish Police Jury is requesting the U.S. Army Corps of Engineers, New Orleans District to provide assistance with a port feasibility assessment for the Cameron Parish under the Planning Assistance to States (PAS) authority of Section 22 of the Water Resources Development Act (WRDA) of 1974 and Section 208 of WRDA of 1992 as amended; and
WHEREAS, grant funding is available through USDA Rural Development for studies to enhance rural development; and
WHEREFORE, in order to sustain growth, the Port, Parish, OEP and future stakeholders need to understand the most beneficial, practical and feasible route for rail access to the Parish.
NOW THEREFORE, BE IT RESOLVED, THAT THE CAMERON PARISH POLICE JURY, HEREBY supports the President of the CAMERON PARISH PORT HARBOR & TERMINAL DISTRICT to apply to the USDA Rural Development Grand Fund for a Rail Feasibility Study.

It was moved by Mr. McDaniel, seconded by Mr. Quinn and carried the Secretary is hereby authorized, empowered and directed to advertise for Public Comment for and to Conduct a Public Hearing to Consider the following Revision to Cameron Parish Code of Ordinances:
CHAPTER 12 LIBRARY SECTION 3(a)
The governing authority of the parish shall, in the ordinance creating a public library, name and appoint, at its option, not less than five citizens nor more than seven citizens of the parish as a board of control for such parish library to serve for terms of one, two, three, four, and five years, the successors of whom shall each be appointed for a term of five years. The president of the police jury shall be ex officio, a member of the board of control for such public library, provided however that the president of the police jury shall have the right to designate another member of the governing authority of the parish to serve in his place and stead on the board of control of such public library.
There being no further business, it was moved by Mr. Quinn, seconded by Mr. Guidry and carried, the meeting was declared adjourned.
